These Terms and Conditions are incorporated in all sales from our website (La Cerqua Tartufi snc). Please read them carefully because by placing an order with us you are bound by them. Your contract is with La Cerqua Tartufi snc C.da Cerreto 16 62026 San Ginesio MC Vat number is IT01955910433.
1) OBJECT OF THE CONTRACT
1.1 With this contract, the Seller sells and buys the purchased material at a distance and offers it for sale on the website www.lacerqua.com, in accordance with the above quantities and prices.
2) PAYMENT METHOD
2.1 Any payment by the Buyer may only be made in accordance with what has been agreed in this order of purchase;
2.2 Any delay in payment – in the relationship between the Supplier and the Customer Acquirer – with respect to the date for the agreed payment, as well as any extension of the payment granted will result in the application of the moratorium interest pursuant to and for the effects of D. Lgs.237 / 2002;
2.3 Our prices are inclusive of all EU taxes, where applicable, while shipping charges are extra. Because of the local conditions we may not be able to deliver to all locations, in this case a full refund is required;
2.4 the goods will remain “La Cerqua Tartufi snc” until receipt of full payment. The buyer therefore buys the property of the goods sold only with the full payment of the agreed price but assumes the risks from the time of delivery in accordance with art. 7523 C.C.
3) TIMES AND DELIVERY MODES
3.1 Shipment times may vary from day one order to a maximum of 30 working days after confirmation. In the event that the Supplier is not in a position to make the shipment within that period, the Buyer will receive an early warning via email, which may decide to confirm the order to the new delivery conditions or withdraw from the order performed.
4) PROTECTION OF THE CONFIDENTIALITY AND TREATMENT OT THE PURCHASERS DATA
4.1 The communication of your personal data by the buyer is a necessary condition for the proper and timely execution of this contract. Failure may not be given to the Buyer’s request;
4.2 The processing of data by La Cerqua Tartufi snc is solely intended for the complete and correct execution of the purchase order received and is carried out in accordance with the provisions of Legislative Decree 796/2003 and Law No.675 /96;
4.3 The buyer can then exercise all the rights provided for in the previous regulations,’
4.4 The buyer, with reference to Law no. 675/96 and the privacy code expressly authorizes the seller to use his / her personal data for the performance of this contract.

5) APPLICABLE LAW AND RENEWAL
5.1 This contract is governed by Italian law;
5.2 As far as not expressly provided here, the applicable laws and regulations applicable to the relationships and the circumstances of this contract under the Rome Convention of 1980 apply.
6) COMPOSITION OF CONTROVERSIE
6.1 Any disputes relating to the application, interpretation and breach of this purchase contract shall be submitted to the Italian jurisdiction;
6.2 All disputes arising out of this contract shall be referred to the mediation procedure at the Chamber of Commerce of Macerata and resolved in accordance with the Settlement Rules of Conformity adopted by it;
6.3 If the Parties intend to bring the ordinary Judicial Authority, any dispute shall be the responsibility of the Macerata Court.
7) FINAL CLAUSE
This Agreement supersedes and supersedes any prior written agreement, agreement, negotiation, or written, between the parties and relating to the subject matter of this contract.
